LiftCARE Warranty

This Supplemental Limited Warranty (“Limited Warranty”) is provided by LiftForward, Inc. (“Warrantor”) for an eligible desktop computer, laptop, tablet, hub or virtual reality headset (“Covered Product”, “Product”) that is leased by you through LiftForward.

 Where is this Limited Warranty valid?

This Limited Warranty is only valid in the continental United States of America, plus Alaska and Hawaii (“Territory”). NOTE: This Limited Warranty is not valid in any outlying U.S. territory, including but not limited to Puerto Rico, or any Canadian province/territory.

 When does this Limited Warranty take effect?

On the date that you initiate the lease of your Product through LiftForward (“Effective Date”).

 How long does coverage last?

Throughout the duration of your 24-month lease (“Term”); or until the product is returned upon expiration of the lease up to 12 months after your Term has expired, provided that continued lease payments are made by You; unless you reach the Limited Warranty’s Maximum first.

 Do I have to register to activate coverage?

No. LiftForward has already received all of the necessary information regarding your Product in order to provide coverage under this Limited Warranty.

 What is covered?

In the event of a mechanical or electrical failure of the covered Product to perform its intended function due to defects in materials or workmanship (“Failure”), including accidental damage from handling (such as damage occurring from drops, liquid spillage, or in association with screen breakage), occurring during the valid Term Lease period, Warrantor agrees to repair or replace the Covered Product with a new or refurbished item (at the Warrantor’s sole discretion). This Agreement only covers a repair or replacement that has been prior authorized by the Warrantor or its representative. REPAIR OR REPLACEMENT MADE BY ANYONE NOT PRIOR AUTHORIZED BY THE WARRANTOR IS NOT COVERED UNDER THIS AGREEMENT. You must take every Reasonable Precaution to protect the Covered Product from deliberate damage. To receive a benefit under this Agreement, You are obligated to provide the Warrantor or its representative with any/all information relating to the cause and nature of any claim in association with the Covered Product. This information may include a sworn written statement on the Warrantor’s forms affirming: 1) that the damage occurred as You has represented; 2) that the Covered Product was functioning properly at the time in which the Failure occurred; and 3) the Reasonable Precautions that were taken with the Covered Product after Failure was suspected. Warrantor reserves the right to perform its own laboratory testing on the Covered Product in order to substantiate any claim made by the You, using manufacturer laboratory testing procedures.

 When am I eligible to file a claim?

This is important to note…CERTAIN COVERAGES UNDER THIS LIMITED WARRANTY ARE ELIGIBLE AT DIFFERENT TIMES; depending on the type of problem you are having with your Product and when such problem occurs in relation to your Product’s original equipment manufacturer (“OEM”) warranty period.

 HERE’S HOW IT WORKS:

 1. DURING YOUR PRODUCT’S OEM WARRANTY PERIOD: As of day one of your Effective Date, you are eligible to submit a claim under this Limited Warranty for damages to your Product that result from an unforeseeable, unintentional single event; particularly, for damages to the Product resulting from dropping it, spilling liquid onto it, or in association with screen breakage.

2. AFTER YOUR PRODUCT’S OEM WARRANTY HAS EXPIRED: In addition to the above, as of the first day after the OEM warranty expires for your Product, you are eligible to submit a claim under this Limited Warranty for a Failure. For this benefit, a “Failure” refers to the mechanical or electrical breakdown of your Product resulting in it no longer being able to perform/function as originally designed and intended, occurring during its routine/normal use by you; which is determined by Warrantor to be directly caused by defects in materials or workmanship.

 How do I initiate a claim?

Simply log on to www.MyProtectionPlan360.com or call customer service toll-free at 1-800-218-4244 to report the problem you are experiencing with your Product and to get instructions for how to obtain service under this Limited Warranty.

For approved claims, WARRANTOR will pay for the postage and shipment costs for the secure mailing of your Product to WARRANTOR’s designated repair center. Upon service completion of your Product, WARRANTOR will also pay for the secure shipment of your repaired (or replaced, if applicable) Product back to you at the return address on file or otherwise specified by you in your initial shipment to the authorized repair facility.

·       For even better service, include a brief description of the problem that you are experiencing with your Product in your shipping package, plus any authorization number or other pertinent information given to you when you initiated your claim.

 What can I expect after I initiate my claim?

Once coverage under this Limited Warranty is confirmed, the WARRANTOR will either repair your Product or send you a replacement. Please note that it is WARRANTOR’s decision to repair your original Product or to provide you with a replacement. And, if a replacement is decided, know that it may be new or refurbished and will be at least the equivalent of your original covered Product, and it may not be the same color as your original Product.

 What is maximum benefit I can receive under this Limited Warranty?

The most WARRANTOR is obligated to provide to you is:

Unlimited number of repairs;

– OR –

One (1) replacement (provided at WARRANTOR’s sole discretion),

 WHICHEVER OCCURS FIRST.

Once either of the above limits have been reached, coverage under this Limited Warranty ends immediately.

 What is NOT covered?

THIS LIMITED WARRANTY DOES NOT COVER ANY BREAKDOWNS, DAMAGES OR LOSSES FOR OR IN ASSOCIATION WITH THE FOLLOWING:

 A. ANY REPAIRS OR REPLACEMENT THAT HAVE/HAS NOT BEEN PRIOR AUTHORIZED BY WARRANTOR (THIS LIMITED WARRANTY IS NOT A REIMBURSEMENT POLICY);

B. ANY ATTACHMENTS (LIKE USB PORTS OR THUMB-DRIVES), STANDS, MOUNTS OR ACCESSORIES (LIKE SPEAKERS, ROUTERS, OR ANY OTHER TYPE OF DIGITAL ENHANCEMENT OR ENTERTAINMENT EQUIPMENT), EXCEPT FOR WHAT IS SPECIFICALLY STATED IN THE “WHAT IS COVERED” SECTION ABOVE.

C. ANY PROBLEMS WHATSOEVER THAT OCCUR TO THE PRODUCT AS A RESULT OF USING ANY OF THE NON-COVERED ITEMS OUTLINED IN ITEM “B)” ABOVE IN CONNECTION WITH THE PRODUCT.

D. ANY SERVICES OTHER THAN THE LABOR/PARTS REQUIRED TO COMPLETE A REPAIR NECESSITATED BY A FAILURE OR OTHER COVERED DAMAGES SPECIFICALLY STATED IN THE “WHAT IS COVERED” SECTION ABOVE (LIKE INSPECTIONS, SOFTWARE UPDATES, GENERAL SERVICING, ETC. ARE NOT COVERED)

E. COSMETIC DAMAGES (LIKE SCRATCHES, COLOR FADE, CORNER CHIPS, ETC. THAT OCCUR OVER TIME WITH GENERAL USE).

F. NOISES OR VIBRATIONS WHEN SUCH IS NOT RELATED TO A DEFINED FAILURE OR OTHER COVERED DAMAGES SPECIFICALLY STATED IN THE “WHAT IS COVERED” SECTION ABOVE.

G. ANY PRODUCT IN WHICH THE SERIAL NUMBER IS REMOVED OR NONVISIBLE, OR THAT APPEARS TO BE ALTERED.

H. TRANSFER OR RESTORATION OF ANY SOFTWARE OR DATA (INCLUDING PERSONALIZATION, APPS, STORED DATA AND STORED MEDIA; LIKE ITUNES, SONGS, RING TONES, PICTURES, VIDEOS, GRAPHICS, CALENDARS, CONTACTS, DOCUMENTS, ETC.)

I. A PROBLEM THAT IS CLEARLY RESULTANT FROM ABUSE (AS IN, THE INTENTIONAL MISUSE AND/OR BREAKAGE OF THE PRODUCT), NEGLIGENCE, OR USE OF THE PRODUCT IN A RECKLESS MANNER OR ANY MANNER THAT IS INCONSISTENT WITH THE OEM’S SPECIFICATIONS AND PERFORMANCE AND ENVIRONMENTAL GUIDELINES.

J. ANY ANIMAL OR INSECT DAMAGES OR ANYTHING RESULTING FROM THE LACK OF ROUTINE CARE, CLEANING AND GENERAL MAINTENANCE OF THE PRODUCT.

K. POWER SURGE (A POWER OVERLOAD CAUSED BY ANY REASON, THAT RESULTS IN DAMAGE AND/OR FAILURE OF YOUR PRODUCT OR ITS BATTERY);

L. ANYTHING COVERED UNDER ANY KIND OF PROPERTY AND/OR HOMEOWNER’S INSURANCE (LIKE BURGLARY/THEFT, LOSS (UNFORESEEN DISAPPEARANCE), EXPOSURE TO WEATHER CONDITIONS AND/OR PERILS OF NATURE (LIKE LIGHTNING STRIKES, TORNADO, HURRICANE, EARTHQUAKE, FLOOD, WIND, HAIL, FIRE, ETC.)

M. ANY SUBSEQUENT OR CONSEQUENTIAL EVENTS RESULTING FROM A COVERED FAILURE OR OTHER COVERED DAMAGES SPECIFICALLY STATED IN THE “WHAT IS COVERED” SECTION ABOVE; INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE, LOST TIME, LOST DATA/MEDIA, LOST WAGES/INCOME OR EDUCATIONAL LOSS (I.E. SCHOOL GRADES/CREDITS) RESULTING FROM: THE BREAKDOWN OF THE PRODUCT OR ANYTHING USED IN ASSOCIATION WITH THE PRODUCT, DELAYS IN SERVICE, OR THE INABILITY TO RENDER SERVICE. (NOTE: SOME STATES DO NOT ALLOW THE EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS EXCLUSION MAY NOT APPLY TO YOU).

N. ANY SERVICES PERFORMED IN CONFLICT WITH THE TERRITORY CLAUSE OF THIS LIMITED WARRANTY (AS DESCRIBED IN “WHERE IS THIS LIMITED WARRANTY VALID” ABOVE).

EXCEPT AS OTHERWISE SPECIFICALLY STATED HEREIN, WARRANTOR DISCLAIM ANY LIABILITY UNDER ANY MANUFACTURER’S WARRANTY, OR UNDER ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH CAN VARY FROM STATE TO STATE.
